DC's Captain Marvel is the original Captain Marvel created by Fawcett Periodicals, but Marvel owns the TRADEMARK for CAPTAIN MARVEL. This means DC can not have a title with the name Captain Marvel, does not mean they can not have a character by that name, unless, the character's name is an original word. Just because Marvel trademarked the name CAPTAIN MARVEL, it DOES NOT mean the right to every series called CAPTAIN MARVEL automatically belong to them. Bottomline, you trademark only cover the work from Point B to Point C, it does not give you automatic ownership of any works from Point A. Unless it is licensed. However, material in PUBLIC DOMAIN belongs to every body!
